1. Acceptance of Terms

By accessing and using Priventia's platform, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Priventia provides a regulatory intelligence platform that helps organisations assess compliance gaps, generate compliance roadmaps, maintain Records of Processing Activities (RoPA), and monitor regulatory changes across multiple jurisdictions.

Priventia also delivers advisory engagements in privacy and AI governance. These terms govern platform access. Advisory is a separate professional engagement, scoped and contracted apart from platform access. Platform access does not itself create an advisory relationship. Priventia’s software supports regulatory compliance and governance work, but does not replace professional judgement or separately contracted advice. Priventia does not provide legal representation.

3. User Accounts

When you create an account with us, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised access

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Interfere with or disrupt the service or servers
• Attempt to gain unauthorised access to any systems
• Transmit viruses, malware, or other harmful code
• Impersonate any person or entity
• Scrape, copy, or reverse engineer the platform

5. Intellectual Property

The platform, including all content, features, and functionality, is owned by Priventia and protected by international copyright, trademark, and other intellectual property laws. You retain all rights to the data you input into the platform.

6. Disclaimer of Warranties

Priventia is provided "as is" and "as available" without warranties of any kind. While we work for accuracy, the platform supports regulatory compliance and governance work and does not replace professional judgement or separately contracted advice. You should consult qualified legal professionals for compliance matters specific to your organisation.

7. Limitation of Liability

To the maximum extent permitted by law, Priventia shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service.

8. Data Processing

When you use our platform to process personal data, you remain the data controller and Priventia acts as a data processor. You warrant that you have the necessary legal basis and authority to process any data entered into the platform.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms of Service or engage in fraudulent, abusive, or illegal activity.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or platform notification. Continued use of the service after changes constitutes acceptance of the modified terms.

11. Governing Law

These terms are governed by the law of the Netherlands, where Priventia is established and registered. Nothing in these terms removes any mandatory protection available to you under the law of your country of residence.
